ToThereOn Terms of Service
Revision: 2026-09-27. Applies to new customers on acceptance. Existing customers retain their prior terms and purchase promises until the required notice and acceptance. This date does not retroactively change an earlier contract's effective date.
1. What ToThereOn is — and is not.
ToThereOn is a remembrance service: a quiet simulated world where an AI re-creation of your companion animal lives ordinary days, drawn from the memories and photographs you share. The days, pictures, and letters written in a remembered style are AI-generated re-creations, not your companion, and not messages from them. ToThereOn is not therapy, counseling, medical or mental-health care, and makes no therapeutic claims. If you are in crisis, contact the resources listed in the app (US: 988; UK: Samaritans 116 123; AU: Lifeline 13 11 14; KR: 109) or local emergency services.
2. Your account and access.
You must be at least 18 and provide accurate information. Access is personal and non-transferable; do not sell, share or rent your account. Keep your credentials safe and tell support promptly about suspected unauthorized access. You are responsible for your own conduct, not automatically for unauthorized activity caused by our security failure. A subscription covers the account and companion identified in the purchase flow, not additional accounts or companions. Creating or deleting accounts or companions does not entitle you to reset quotas or repeat introductory offers.
3. What you upload.
You confirm that you have the right to share what you upload, that photographs show your companion and no people (photographs containing people are excluded from AI processing; do not upload photographs of children), and that letters are your own words. You keep ownership of what you upload; you grant us only the license needed to operate the service (storing, processing with the AI providers named in the Privacy Policy, and generating your world's content). We never use your uploads to train AI models or for advertising.
The service software, design, brand and other service materials remain ours or our licensors'; your subscription does not transfer those rights. You may keep and personally share your own generated letters and pictures, subject to others' rights. We do not promise that generated output is unique, copyrightable or free of third-party rights. Do not resell access to the service. Posting to the community grants only the permission needed to display, distribute within the service and moderate the copy you chose to share; it is not permission to use private memories in our advertising. Withdrawal, deletion and necessary retention follow the Privacy Policy.
4. Subscriptions
- New Whop plans: Free (USD $0) · Standard (USD $9.99 every 30 days) · Premium (USD $19.99 every 30 days). Available plans and checkout access are shown in Settings. ToThereOn supplies the service; Whop processes payments. Historical Polar subscriptions retain their original prices, billing intervals and handling through Polar.
- New Whop paid plans renew automatically every 30 days until you cancel, with separate agreement at checkout. Check the final currency, amount and any tax before paying. A 30-day period is not a calendar month. Settings shows the next billing date recorded for your subscription. Existing confirmation, cancellation-information and renewal-notice commitments remain in effect.
- Tax treatment depends on the applicable account tax mode and customer jurisdiction. Whop does not assume all seller registration, tax, service or refund obligations. Review the tax and seller details displayed at checkout and on your receipt.
- Cancel anytime online in Settings. Accepted period-end cancellation stops future renewals; paid access continues through the verified paid period, then changes to Free. Cancellation alone does not delete existing records. Free provides basic record access and one letter submission per UTC calendar month across the account, with any existing legacy allowance preserved. Paid letter submissions remain subject to the displayed rolling 24-hour limit and generation budgets. AI replies and images depend on processing availability; generation may pause when processing is unavailable. Video and audio services are not available. A subscription does not buy unlimited generation or permanent access.
- UK/EU users: mandatory cancellation rights remain available. A request for immediate supply does not remove our worldwide first-subscription 14-day full-refund promise. See the Refund Policy; existing statutory or contractual rights are not reduced by this clarification.
- Australian users: our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies those guarantees; remedies for major failures include refund rights under the ACL.
- The features, quantities, reset periods and access period disclosed when you buy define your plan. Unused generation allowances are service limits, not money, a deposit or a refundable wallet. There is no cash conversion or transfer between accounts; this does not remove a refund right for the subscription payment. Roadmaps, examples and preview features are not additional purchase promises unless expressly included in your offer. We will not retroactively reduce purchased entitlements by changing a limit on a web page.
- Cancellation stops renewal; it does not itself request a refund for the current period. The Refund Policy at /refunds explains the separate request and applicable exceptions. If online cancellation is unavailable, contact
ottystartup@gmail.com; we will use the time we receive an identifiable cancellation request, not the time we finish handling it, and correct a renewal charged after that request. A payment-provider receipt or checkout return alone is not a delivery confirmation; access is matched to a verified payment. If matching fails, contact us to restore access or receive the applicable remedy.
5. Fair use, community and enforcement.
No unlawful content, infringement, impersonation, harassment, unsolicited promotions, unauthorized scraping, account resale, or attempts to obtain others' data. Do not bypass photo checks, security controls, rate limits, payment checks or generation budgets, including by automated requests or multiple accounts. Legitimate accessibility tools and authorized integrations are not prohibited merely because they automate an interaction. Community publication and recommendations are not guaranteed; we may withhold or remove submissions that breach these rules, explain the reason where lawful and allow review through support. Reporting a problem, posting an honest review or using a lawful refund or payment dispute is not abuse.
We may proportionately restrict affected features or suspend an account for a material breach, fraud or a genuine security risk. We normally give reasons and a reasonable opportunity to correct or contest the issue; immediate protective action may be necessary for serious harm, unlawful activity or a legal obligation. We review contested restrictions through support and restore access where a restriction was mistaken. Suspension does not authorize confiscating payments or destroying your records: refund, export and deletion rights still apply. We may recover losses caused by your unlawful conduct only where responsibility and the amount are established under applicable law; there is no automatic penalty or blanket duty to pay our legal costs.
6. Safety.
The service watches for expressions of self-harm crisis in what you write and responds by showing human crisis resources; our published Crisis Support Protocol at /crisis-protocol describes this. The AI is designed never to counsel you through a crisis — it hands you to people.
7. Service availability and responsibility.
Generated content can be inaccurate or imperfect; resemblance is a re-creation, not a continuation. We do not promise a particular emotional outcome, exact likeness, uniqueness, instant generation or a specific uptime percentage unless your purchase expressly says so. We remain responsible for providing the described service with reasonable care and skill. Maintenance, safety review or provider outages may delay processing; we will take reasonable steps to restore affected service and give available status information. A third-party outage is not a blanket exemption from our delivery or refund obligations. Material non-delivery or a service that does not match its description remains eligible for correction, price reduction, cancellation or refund as required by law and our Refund Policy.
This is a personal remembrance service, not a business-critical system. We do not undertake responsibility for business revenue, profits or business opportunities you choose to base on it, or losses that neither party could reasonably foresee when contracting. These limits do not exclude reasonably foreseeable consumer loss caused by our breach. For a lawful business-use claim only, our aggregate liability is limited to the fees you paid for the service in the 12 months before the event giving rise to the claim. That monetary cap does not apply to consumer claims. No exclusion or cap applies to fraud, willful misconduct, gross negligence, death or personal injury, mandatory data-protection liability, or any other liability that cannot lawfully be limited. Refund obligations and your mandatory consumer remedies are not reduced by a damages cap.
If we permanently close the service, we will give reasonable advance notice and export instructions where practicable, stop future billing and refund prepaid service we cannot supply. An urgent legal or security requirement may limit advance notice, not remove your applicable remedies. Retention after cancellation and deletion follow the Privacy Policy; no lifetime storage is sold.
8. Changes and existing customers.
We may make reasonable changes for legal requirements, security, abuse prevention, technology or supplier changes, or changes to our service offerings. Material changes to terms, price or paid features require at least 30 days' advance email/in-app notice explaining the change and its effective date. A price increase applies only to a future renewal after the notice period, not an already purchased period; we obtain fresh agreement when required. An urgent legal or security change may take effect sooner only to the extent necessary, with prompt explanation. If it materially prevents us supplying your paid service, the applicable cancellation and refund remedies remain available.
You may cancel before a future change applies. We will not treat silence as consent where affirmative agreement is required. Existing purchases and accrued rights remain governed by their original promises. Publication of this revision does not itself replace an existing customer's agreement: until the required notice and any required acceptance have occurred, their prior terms continue to apply. New customers receive this revision for acceptance before account use. The Privacy Policy does not give us new data-processing consent simply because these terms change.
9. Law, questions and interpretation.
These terms are governed by the laws of the Republic of Korea. Consumers in every country, including Korea, the US, UK, EU and Australia, retain applicable mandatory local protections and the courts available under mandatory jurisdiction rules. Contact support to help resolve an issue; this is not a compulsory waiting period before a complaint, chargeback or legal claim. No mandatory arbitration or class-action waiver is imposed by these terms. If a provision is unenforceable, the remaining provisions continue where lawful; it is not replaced automatically by a broader restriction. A specific purchase promise prevails over conflicting general wording, and nothing here overrides mandatory rights. English and Korean versions are intended to have the same meaning; a translation conflict will not reduce rights in the version presented to you at purchase.
